Will a New Bill Change Operations at the Prescott Lakes Athletic club?


At the urging of some Prescott Lakes residents, State Representative Andy Tobin has begun work on a bill aiming to deal with dues and ownership at the Prescott Lakes Athletic Club.  Despite the fact that the property is privately owned by the developer of the subdivision, athletic club membership is mandatory for Prescott Lakes homeowners.  The club provides a workout room, swimming pool and other activities - membership fees are $75/month. 

Although the membership requirement is clearly defined at the time of home purchase, some residents are up in arms over the fact that the community is offered little voice over club maintenance and operations.  These homeowners have come together to form a group, Homeowners Against Mandatory Private Amenities (HAMPA), to work toward their goals.  They feel that they were not given clear disclosure of the fact that the community club was privately held by the developer, and they would like the ability to help decide how their "automatic" monthly dues should be allocated.   

Prescott Lakes Developer, Jeff Davis, suggests that the structure is typical of many master-planned communities all over the U.S.  He also states the homeowners do have a voice through their homeowner advisory committee which exists to help make programming decisions. 

While the direction of this situation is unclear, Rep. Tobin ultimately hopes to make homeowner association documents easier for buyers to interpret at the time of purchase.
